Tenant Brochure
- The Lincoln Municipal Code 5.38.085 was enacted in October of 2004. The code requires landlords to give tenants a brochure outlining tenant's rights and landlord's duties under the Nebraska Landlord/Tenant Act and the Lincoln Municipal Code.
- The brochure informs the tenant that they must comply with "community housing codes" and other general provisions of the Landlord and Tenant Act. It also informs the tenant of the procedure to follow regarding "Maintenance Requests".
- The procedure outlined in the brochure informs the tenant to first contact the landlord before contacting the codes department. If the landlord fails to remedy the problem the tenant is then instructed to contact Building and Safety who will arrange an inspection. The inspector will determine if a violation exists and notify the landlord of the violation and a repair deadline. The brochure identifies twelve of the most common items found in violation of city code.
- The ordinance reads as follows: "5.38.085 Duty to Provide Tenant Brochure for Apartment House, Rooming and Lodging Houses. Upon commencement of any lease of an apartment, rooming or lodging house unit to a tenant, the owner or representative of said house shall provide the tenant with a brochure, as approved by
the Building Official, outlining the tenant’s rights and landlord’s duties under the Nebraska tenant/landlord act and under the City of Lincoln minimum housing code. The brochure will include common housing code requirements, will outline a complaint procedure for alleged code violations and the brochure will note that in accordance with state law an owner or representative cannot retaliate against a complaining tenant. - I recommend that landlords add a provision to their written rental agreement that acknowledges receipt of the brochure (which you must give them) or have the tenant sign a separage disclosure statement. Click here to download a copy of the lease provision.
- Please note that landlords could be charged with a misdemeanor for failing to comply with the ordinance.
